Welcome to BrainLea. These Terms and Conditions ("Terms") govern your access to and use of the website www.brainlea.com ("Website") and our educational coding services, online classroom platforms, and sandboxes (collectively, "Services") operated by BrainLea ("Company", "we", "us", or "our").
1Acceptance of Terms
By accessing, browsing, or using our Website or Services, you agree to be bound by these Terms and our Privacy Policy. If you are registering a student, you represent that you are the parent or legal guardian of that student and agree to these Terms on their behalf. If you do not agree with any part of these Terms, please do not use our Services.
2User Eligibility and Accounts
Our coding programs target children aged 7 to 15. However, the legal contracting party is always the parent or legal guardian:
- Parents or guardians must create the account, provide accurate billing details, and manage scheduling.
- You agree to keep all login credentials confidential and secure. You are fully responsible for all activities occurring under your registered account.
- If you discover any unauthorized use of your account, you must notify us immediately.
3Billing, Payments & Subscriptions
Access to our live classrooms and curriculum requires active subscription packages or course purchases:
Pricing & Payments
All prices are as stated on our checkout pages. Payment processing is managed securely through Stripe. You authorize us to charge your specified credit card or payment method for all purchases.
Subscription Renewals
Monthly subscriptions renew automatically on your billing anniversary. You can cancel your subscription at any time through your dashboard parent portal. Cancellation will prevent subsequent renewals, but no partial refunds will be given for the active monthly cycle.
Cancellation Constraints
All refund eligibility, trial periods, and scheduling changes (including the 24-hour notice rescheduling rule for 1:1 classes) are governed strictly by our dedicated Cancellation & Refund Policy.
4Student Code Ownership & Licensing
We believe in fostering creativity and ownership. Here are the rules regarding student creations:
- Student Ownership: Students own 100% of the copyright and intellectual property rights in the original code, games, visual art, and websites they build while using our Services.
- BrainLea License: To allow us to host, display, and support student code, you grant BrainLea a non-exclusive, worldwide, royalty-free, perpetual, and sublicensable license to host, compile, run, display, and share the student's project files. This license is used specifically to show projects in our Student Showcase Gallery, allow class playback, and display code to classmates or for educational/promotional purposes.
- Revoking Sharing: Parents can request to make any project private or remove it from the Student Gallery at any time by editing sandbox privacy settings or emailing support.
5Platform Content & Intellectual Property
All curriculum designs, lesson slides, programming video materials, logos, branding, layout assets, software compilers, and textbook materials provided by BrainLea are the exclusive property of BrainLea or its licensors. They are protected by copyright, trademark, and trade secret laws. Parents and students are granted a limited, personal, non-transferable, and revocable license to access educational materials solely for private, non-commercial learning.
6Classroom Conduct and Behavior
To maintain a supportive and safe learning environment, all students must adhere to our zero-tolerance rules regarding harassment, bullying, disruption, or inappropriate language during live Zoom/Jitsi classes. 7Third-Party Links & Services
Our sandbox environments and courses may reference external tools (such as GitHub, Scratch, or Canva) or display external URLs. We do not control or endorse the content or safety policies of third-party platforms, and recommend that parents review external terms when students interact outside our Services.
8Disclaimer of Warranties
Our Website, sandboxes, and educational Services are provided on an "as is" and "as available" basis, without warranties of any kind. While we strive to employ expert mentors, we do not guarantee specific learning outcomes, career advancements, or academic results. 9Limitation of Liability
To the maximum extent permitted by applicable law, BrainLea and its officers, directors, employees, or mentors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or classroom service interruptions, even if we were informed of the possibility of such damages.
10Governing Law and Jurisdiction
These Terms and your relationship with BrainLea are governed by the laws of India, without regard to conflict of laws principles. You agree that any legal actions or disputes arising under these Terms shall be resolved exclusively within the courts located in Kolkata, West Bengal, India.
